Roberts Nehmer McKee Privacy Policy
Roberts Nehmer McKee is bound by the National Privacy Principles as set out in the Privacy Act 1988 (Cth). The Principles regulate, among other matters, the way private sector organisations should collect, use, keep secure, disclose and give people access to their personal and sensitive information.
Personal Information Collected
The main reason why Roberts Nehmer McKee collects personal and sensitive information is to allow us to provide you with the expert legal products and services that you instruct us to provide. Generally, this information is collected directly from you or from a Government information search database or other publicly available database, as part of Commercial, Litigation, Criminal and Family law or Conveyancing proceedings. We also record your email address every time you send an email message to us and users should be aware that there are inherent risks in transmitting information across the Internet.
What your Personal Information Is
Personal information is information or an opinion (including information or an opinion forming part of a database) whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion. It relates to a natural living person. A natural person is a human being rather than, for example, a company, which may in some circumstances, be recognised as a legal 'person' under the law.
What your Sensitive Information Is
Sensitive information is a subset of personal information. It means information or opinion about an individual's racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record or health information about an individual.
Use and Disclosure of Personal Information
Generally, we will tell you why we are collecting information when we collect it and how we plan to use and disclose it, or these things will be obvious when we collect the information.
In most cases we use and disclose your information only as far as is required to complete your instructions and to fulfil administrative functions associated with your instructions. As a general rule we do not collect sensitive information. However, if we do, it will usually be for the purposes of providing our products or services and if the law requires us to. We will seek your consent to collect it.
In relation to the preparation of, or conduct of proceedings before any court or tribunal, we are also permitted to use or disclose your personal information where there is reasonably necessary for the conduct of those proceedings.
We may also use and disclose your personal information for direct marketing purposes or to help us develop and inform you of other services that we believe may interest you. If you do not wish for your persoanl information to be disclosed in this way, you should advise the privacy officer at the address below.
In all other respects Roberts Nehmer McKee will continue to strictly observe the common law duty of confidentiality as between solicitor and client with regards to your personal information.
Personal Information Security
Roberts Nehmer McKee strives to ensure the security, integrity and privacy of any personally identifiable information of our clients. We will take all reasonable steps to protect the personal information we hold from misuse and loss and from unauthorised access. Both physical and electronic security measures are strictly enforced.
Access to Personal Information
In relation to existing or anticipated legal proceedings, Roberts Nehmer McKee is not required to disclose certain information unless it is accessible through the legal discovery process. In all other respects, you generally have a right to access personal information which we hold about you. If at any time you would like to access the information we hold about you, you should make a request to the solicitor or professional staff member at Roberts Nehmer McKee who has access to that information. Otherwise your request should be made in writing and forwarded to us at the address set out below. If we deny your request for access, we will let you know why.
Personal Information Quality and Security
Where it is established that personal information we hold about you is not accurate, complete or up-to-date, we will take all reasonable steps to correct it. We will also take all reasonable steps to protect your personal information from misuse and loss and from unauthorised access.
When your information is no longer needed, we will also take reasonable steps to destroy or permanently de-identify it.
Personal Information and Third Parties
If you supply us with information about another person, you agree to tell that person that we are holding personal information about them. You also agree to tell them that they may access that personal information and that this information may be disclosed to third a party organisation for the purpose of carrying out your instructions.
Complaints
Any complaints about Roberts Nehmer McKee’s information handling processes should be made in writing. As the legislative provisions can be quite technical, individuals wishing to make a complaint are urged to discuss their complaint with staff of the Privacy Commissioner by ringing the Privacy Commissioner's hotline service on 1300 363 992.
